Terms of Service
Last updated: 17 October 2026
These Terms of Service (“Terms”) govern your use of the TradeDraft website platform operated by Ramp Up App Pty Ltd trading as TradeDraft (ABN 31 686 434 891) (“we”, “us”, “our”). By using our services, you agree to these Terms.
1. Services
TradeDraft provides website design, hosting, and management services for trade and service businesses in Australia. We build, host, and maintain your website on a subscription basis.
2. Account and access
- You must provide accurate business and contact information
- You are responsible for maintaining the security of your admin account credentials
- You must be authorised to act on behalf of the business you register
- One subscription covers one business website
3. Pricing and payment
- Pricing is as published on our website at the time of sign-up
- The one-time go-live fee is charged only after you approve your website, and is non-refundable once your site is live, except where a refund is required by law
- Subscriptions are billed in advance via Stripe and renew automatically each month or year, according to the billing period you select, unless you cancel renewal before the next billing date
- All prices are in Australian dollars (AUD) and exclude GST, which is added at checkout
- Annual plans are 12 months paid in advance at the published discount; the go-live fee still applies
- Price changes apply from the next renewal date that falls at least 30 days after we give you written notice. They do not increase the price of a period you have already paid for
3a. Studios
A Studios build runs in this order:
- We design the first three sections of your homepage for free (the free homepage concept). You owe nothing for it.
- If you approve the free concept (“concept sign-off”), you pay a $4,950 deposit, half the build fee.
- We design the full site, with up to 2 design rounds. If the full-site design doesn’t land after those rounds, the deposit is refunded in full (see “Design guarantee” below).
- We build the site, and the second $4,950 is due at go-live, after you approve the site.
A Studios site has its own build fee, then runs on one of our monthly plans:
- A $9,900 + GST build fee, half at concept sign-off and half at go-live, then your choice of monthly plan: Standard at $149 + GST per month or Growth at $199 + GST per month, or 15% off either paid a year up front.
- The build fee is paid in two halves: a $4,950 deposit at concept sign-off, when you approve your free homepage concept, and $4,950 at go-live, after you approve the site
- The build includes 2 design rounds on the full site and 2 revision rounds on the built site, and up to 12 core pages
- From go-live you choose a monthly plan, Standard or Growth, billed monthly or annually on the terms in section 3, and you get what that plan includes. There is no separate go-live fee for a Studios site: the build fee covers it. Pro is not yet available
- Work beyond that, such as more pages after the build, more core pages, a redesign or a new audience, is quoted in writing before we start
- Add-ons are billed monthly from the month they start, as published on our Studios page
Design guarantee. If, after 2 design rounds on the full site, you don’t approve the design, tell us in writing before we start building. We refund the $4,950 deposit in full, including GST, to the card or account you paid from, within 14 days. Once you approve the full-site design, the guarantee no longer applies.
Timeline. We aim to take a Studios site from deposit to go-live in 4 weeks. That is a target, not a promise. It depends on you sending your content (words, photos, case studies and approvals) when we ask for it, usually in week 3. If content or approvals arrive late, go-live moves back by at least the same amount. A delay on your side does not, by itself, make the deposit refundable; your rights under Australian Consumer Law still apply.
If you leave. When a Studios subscription ends:
- Your content is yours. We give you a full export of the pages, essays, case studies, resources and images you published, in standard formats
- Your domain is yours. If we registered it for you, we transfer it to you; if you registered it, we release it and help you point it elsewhere
- The design system, page templates, code and platform remain ours (see section 7). They are licensed to you while you subscribe and the licence ends with the subscription, so the design itself doesn’t leave with the export
4. Cancellation
- You can cancel renewal at any time before your next billing date. Ask us from your dashboard (Billing → Change your plan) or by email, and we confirm it in writing
- Your website remains live until the end of the current billing period
- Annual payments are not refunded for a change of mind; service continues until the paid period ends. This does not limit any refund or other remedy required by law
- If we end your subscription without fault on your part, we refund the unused portion of prepaid subscription fees on a pro-rata basis
- When your paid subscription ends, your site goes offline. We retain your website data for 90 days in case you change your mind. Records needed for legal or accounting obligations may be kept longer.
- You can ask us for an export of your content at any time, and we send it within 10 business days
5. Your content
You retain ownership of all content you provide (text, images, logos, business information). By uploading content, you grant us a licence to host and display it as part of your website.
You are responsible for ensuring your content:
- Does not infringe any third-party intellectual property rights
- Is accurate and not misleading
- Complies with Australian Consumer Law and relevant industry regulations
- Does not contain unlawful, defamatory, or harmful material
5a. TradeDraft Directory
On our trades plans (not Studios), your business is included in the TradeDraft Directory, a public listing of businesses on TradeDraft. Inclusion is on by default from your first paid subscription. The Directory is being prepared, and listings appear once it launches.
- Your listing shows business details from your website: business name, trade and services, the suburbs you serve, phone number, opening hours, licence and ABN details, your own photos and a link to your website. We show your street address only if you choose to.
- You can turn your listing off at any time in your dashboard. It is removed within one business day, and it is removed when your subscription ends.
- We may decide how listings are ordered and grouped, and we may hide or remove a listing that is inaccurate, out of date or breaches these Terms.
- The licence in section 5 covers displaying this content in the Directory.
6. Our responsibilities
- We will build and launch your website within the agreed timeframe (typically 5 business days on our trades plans; for Studios, see section 3a)
- We will host your website with commercially reasonable uptime
- We will keep your website software up to date and secure
- We will respond to support requests within 1 business day
- We will not share your data except as described in our Privacy Policy
7. Intellectual property
The TradeDraft platform, including its design templates, code, and systems, remains our intellectual property. Your subscription grants you a licence to use the platform for your website. Custom design work created for your site is licensed to you for the duration of your subscription.
8. Limitation of liability
Subject to rights and liabilities that cannot lawfully be excluded or limited, our aggregate liability arising from the affected services is limited to the fees paid or payable for those services during the 12 months preceding the event giving rise to the claim. Subject to those same protections, we are not liable for indirect, incidental or consequential loss, including lost profits or business interruption.
Nothing in these Terms excludes or limits any consumer guarantees under the Australian Consumer Law that cannot be excluded by law.
9. Suspension and termination
We may suspend or terminate your service if:
- Payment is overdue by more than 14 days. If a payment fails, we email you straight away and retry it over the following 14 days, with a reminder each time; if it still can’t be taken, your website is paused until payment is made and comes back as soon as it is
- Your content violates these Terms
- Your use of the platform poses a security risk to other users
We will provide reasonable notice before suspension except in urgent security situations.
10. Disputes
These Terms are governed by the laws of Victoria, Australia. Any disputes will first be addressed through good-faith negotiation. If unresolved, disputes may be referred to mediation before any court proceedings.
11. Changes to these Terms or services
We may update these Terms or our services from time to time. We will give you at least 30 days' notice by email of material changes. If a change we introduce to these Terms or the services materially disadvantages you during a prepaid period, you can end the affected service before the change takes effect and receive a pro-rata refund of unused prepaid subscription fees. Otherwise, continuing to use the service after the change takes effect means you accept the updated Terms. Price changes follow section 3. Nothing in this section limits rights that cannot lawfully be excluded.
